Employee Rights Under the THCA
Employees have specific rights under the Texas Hazardous Communication Act. Those rights are listed below: Employees have the right to be informed of hazardous materials used in the work place.
Employees are to have access to material safety data sheets (MSDS) and the workplace chemical list during normal work hours.
Upon request employees may obtain copies of MSDS sheets and the workplace chemical list.
Employees shall receive training by the University Safety Office on the hazards of chemicals and measures they can take to protect themselves from those hazards, and shall be provided with appropriate personal equipment (PPE). This training shall be provided as needed. The safety Office will provide training to new or newly assigned employees before the employees work with or in a work area containing hazardous chemicals.
The Safety Office will provide employees with PPE to ensure safe working standards.
Waiver of rights as a condition
Employees shall not be required to work with hazardous chemical from unlabeled containers, except portable containers for immediate use, the contents of which are known to the user.
No reprisals for employees who file complaints in regard to the requirements of the Texas Hazard Communication Act. The university fully supports the rights of it's employees under the THCA.
